Earplug Lawsuit Update

The 3M earplug lawsuit was settled for $6 billion on August 28, 2023. The settlement resolves around 260,000 lawsuits filed by U.S. military personnel who allege hearing loss and other injuries due to 3M’s defective earplugs.

The settlement agreement is still pending court approval. Once approved, distribution of the settlement money will begin, a process that is expected to take several years.

In the meantime, 3M has agreed to establish a trust fund to compensate the victims of the defective earplugs. The trust fund will be managed by a court-appointed trustee and will be independent of 3M.

To be eligible for compensation from the trust fund, victims must have used 3M’s Combat Arms Earplugs, Version 2 or Dual-Ended Combat Arms Earplugs between 2002 and 2015 and have suffered hearing loss or tinnitus as a result.

Victims can file claims with the trust fund once it is established. It is not yet clear when the trust fund will be established or when victims will be able to start filing claims.
