GlaxoSmithKline Class Action Lawsuit

Paxil Class Action lawsuit is yet another lawsuit which was filed by the consumers against the GlaxoSmithKline Company. This is due to the fact that they have been marketing the anti-depressant drug, Paxil, as the treatment for Irritable Bowel Syndrome (IBS). When the FDA approved Paxil for sale, they included Paxil with other antidepressant drugs such as Elavil and Zoloft. GlaxoSmithKline was so confident about the product that they included it on their list of medicines containing anti-depressants. They claimed that Paxil was capable of treating depression and anxiety together with IBS.

The FDA did not approve Paxil as a treatment for IBS but only claimed that the drug was effective for treating depression and anxiety. The class action lawsuit asserts that GlaxoSmithKline knew about the risks of the drug and did nothing to correct those risks, leading to the victims filing the lawsuit. GlaxoSmithKline has also received a complaint from the State of New York, who is responsible for setting the rules and regulations for pharmacies in the state. The rules and regulations for pharmacies state that patients should not take more than two tablets of a single product.

The class action lawsuit involves more than two hundred plaintiffs. All of the plaintiffs are asking for financial compensation, medical care, and other things that were supposed to be provided to them under the terms of the original agreement. The court has set a date for the case to be heard by a federal judge. If the lawsuit gets to go to trial GlaxoSmithKline will have to prove that the injuries were actually caused by taking the incorrect pill and that they were not induced by improper use. The company can only prove that they were unaware of the potential dangers.

There is also another class action lawsuit referred to as the Urgent Order of Default. This case involves approximately one hundred and twenty people who feel that they have been the victim of Paxil negligence. Because of this situation, the company has agreed to settle their claims for a percentage of settlement money. If the case goes to trial GlaxoSmithKline will have to prove that their actions were within the ranges allowed by law.

Both of these class action lawsuits will force GlaxoSmithKline to prove that they mis-sold Paxil. The class action lawsuit is their first chance to show what kind of harm the drug can cause. In addition to financial damages, the judge could hold GlaxoSmithKline accountable for pain and suffering, lost wages, and future medical care. This could make the company think twice about selling drugs with ingredients that could cause health problems in the future.

GlaxoSmithKline did not admit or try to cover up the risks associated with their product. Instead, they attempted to provide proof of their claims in court. The company’s defense strategy was to provide proof that the benefits of the drug outweigh the risks and to convince the judge and jury that their class action lawsuit should go forward. This proves that the company is willing to spend money to protect its profits instead of make any type of changes to increase customer safety. As of right now, GlaxoSmithKline is not facing any financial damages yet this class action lawsuit may bring about more concerns to them.
